Estate Planning

One of Paul Miller's goals during client conferences is to get to know you and your family in order to be able to formulate a custom estate plan satisfying your objectives.

When the extent of the property owned by each spouse is unclear, Mr. Miller uses property agreements to define the separate property owned by each of you and your jointly owned community property to avoid litigation to determine which assets pass under clauses in trust agreements intended to distribute the assets owned by only one of you. 

Paul Miller is careful in handling the beneficiary designations for retirement plans, IRAs, annuities, and life insurance policies, which may be your most valuable assets. In the case of these kinds of assets which are community property, if the spouse who is not named as the owner fails to consent to the beneficiary selected by the spouse owning the plan, then if the non consenting spouse dies first their community property half of the benefits pass to the non consenting spouse's estate, rather than to the beneficiaries selected by the named owner of the plan. Trust Administration

Administering a trust involves various notices, affidavits, deeds, trust operating instructions, appraisals, and customized funding of subtrusts to make them easier to manage for the survivor. Paul Miller evaluates the need for disclaimers to save taxes and distribute assets sooner to children. He has helped operate 12 businesses held in estates, trusts, or received in distributions.
